On Saturday I received a letter from the NVC stating that our petition “will be forwarded to the appropriate visa-issuing post” where the visa interview will take place. This, of course, means that the US Embassy in Brussels will start to handle some measure of paperwork. The second NOA was correct in its time estimate.

No date of receipt is indicated but the letter is dated March 29, 2005. A total of 50 days have passed since I mailed the petition packet.

Saturday afternoon I finished printing and copying the petition packet for Kristien. Not including dividers, the end result is 49 pages. A lot of preparation helped to speed the process. I sorted through all the photos, e-mails, and travel documents I wanted to include. Scanning documents and pasting them into Word took the longest amount of time. Also, picking appropriate e-mails from the several hundred over the past five years was no small task.

Here’s what I included:

USPS Money Order for $165

Cover Letter

I-129F

I-129F Supplement

G-325A (Petitioner)

G-325A (Beneficiary)

Birth Certificate

Passport

Letters of Intent to Marry

Photographs

Receipts and Travel Documents

E-mails

It’s going in the mail tomorrow, certified, with a return receipt.

If the USCIS makes all forms available as PDF documents, why can’t they all have fillable form fields? I prefer to have everything typed neatly. The I-129F isn’t a long form but it’s one of the forms that you need to complete by printing or typing. Maybe it’s a test. When applying for a job, employers probably take note of who types applications and who doesn’t. I’m sure these immigration officials see some terrible handwriting and are grateful to get typed forms.

The second form, but still part of the whole I-129F packet, is the Form G-325A, Biographic Information. The version is 9/11/00. There is no filing fee because it is supplemental to the I-129F. A biographic form is completed for both Kristien and me.

So, to apply for a K-1 visa the petitioner needs only to complete two forms. That’s not too complicated. But the burden of proof is on the petitioner to establish that the relationship is legitimate. That requires photos, copies of plane tickets, and anything else that would provide sufficient evidence that Kristien and I have met. That’s going to take some time to compile. I’ll write again when the packet is ready and when I’ve submitted it.

The I-129F petition is the first form I will be completing for the K-1 visa process. I’ll be sending in the 4/16/04 version. Because the U.S. is divided into separate filing regions, Florida–my state–is required to file with the Texas Service Center.

The common procedures applicable to all Service Centers are very important. The last thing a clerk wants to see is a creative application that makes it hard to verify the contents. It’s in my best interest to follow them exactly.

VisaJourney also has a step-by-step guide for filing a K-1 visa.
